1. Introduction

Welcome to Chanlay International Trading Company ("we", "our", or "us"). These Terms of Service ("Terms") set out the legally binding terms and conditions governing your use of our website https://chanley-hk.myshopify.com ("the Site") and the purchase of products from us.

We are a Hong Kong registered unlimited company. Our primary e-commerce operations are directed towards customers in Malaysia. All orders are fulfilled from our warehouse in Guangzhou, China, and shipped to your designated delivery address.

By accessing our Site, browsing our products, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy. These Terms apply to all users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

We reserve the right to update, change, or replace any part of these Terms at any time. It is your responsibility to check this page periodically for changes. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.

2. Definitions

Throughout these Terms, the following definitions apply:

"We", "us", or "our" refers to Chanlay International Trading Company, a Hong Kong registered unlimited company and the owner and operator of the Site.

"You" or "user" refers to any individual or entity who accesses or uses the Site.

"Order" refers to a request by you to purchase Products from us through the Site.

"Working Day" means any day other than Saturday, Sunday, or a public holiday in Hong Kong or Mainland China.

4. Orders & Pricing

4.1 Product Availability

All orders are subject to product availability. We make every effort to ensure that items shown on our Site are in stock. However, in the event that an item is unavailable after you place an order, we will notify you as soon as possible and offer you the option of a full refund, store credit, or a replacement item of equivalent value.

4.2 Pricing

All prices displayed on our Site are in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without notice.

While we strive to ensure all pricing information is accurate, errors may occasionally occur. In the event that a Product is listed at an incorrect price due to a typographical error or any other reason, we reserve the right to refuse or cancel any orders placed for that Product, even if the order has been confirmed and your payment has been processed. In such cases, we will issue a full refund.

4.3 Order Acceptance

Your receipt of an order confirmation email does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason at any time after receipt. A binding contract between you and us is formed only when we dispatch the Product(s) to you from our Guangzhou warehouse and send a shipping confirmation email.

4.4 Promotions & Discounts

From time to time, we may offer promotional codes, discounts, or special offers. These are subject to specific terms and conditions which will be communicated at the time of the promotion. Unless otherwise stated, promotional codes cannot be combined with other offers, cannot be applied to previous purchases, and have no cash value.

5. Payment

We accept the following payment methods on our Site:

By providing your payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your order (including any applicable taxes and shipping fees).

All payment transactions are processed through secure, PCI-DSS compliant payment gateways. We do not store your complete credit card details on our servers.

If your payment cannot be processed or is declined, we reserve the right to cancel your order. You are responsible for any fees or charges imposed by your bank or payment provider.

6. Cross-Border Shipping

As your order is shipped from Guangzhou, China, to Malaysia, it is classified as a cross-border shipment. This means your parcel will be subject to customs inspection and clearance upon entry into Malaysia. You may be required to provide additional documentation or information to facilitate customs clearance.

Please be aware that Malaysian customs authorities may impose import duties, sales tax (SST), or other charges on your order. These charges are your sole responsibility and are not included in the item price or shipping cost displayed at checkout. We have no control over these charges and cannot predict their exact amount.

6.1 Delivery Times

Estimated delivery times are provided as a guideline and commence from the date of shipping from Guangzhou, not the date of order. Delivery times may vary due to factors beyond our control, including but not limited to courier delays, customs processing in Malaysia, weather conditions, and public holidays in China, Hong Kong, or Malaysia.

6.2 Risk of Loss

All items purchased from our Site are shipped pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier in Guangzhou. You are responsible for filing any claims with the carrier for damaged and/or lost shipments.

6.3 Failed Deliveries

If a delivery cannot be completed due to incorrect address information provided by you, refusal to accept delivery, or failure to collect the parcel within the specified holding period, the parcel may be returned to our Guangzhou warehouse. In such cases, you may be responsible for additional shipping charges for re-delivery, or we may issue a refund minus shipping and handling fees.

6.4 International Orders

For international orders (outside Malaysia), you may be subject to import duties, taxes, and customs clearance fees levied by the destination country. These charges are your responsibility and are not included in the item price or shipping cost. We have no control over these charges and cannot predict their amount. Please contact your local customs office for more information.

7. Returns, Exchanges & Refunds

We want you to love your purchase. If you are not completely satisfied, we offer the following return and exchange policy:

7.1 Return Eligibility

To be eligible for a return or exchange, the following conditions must be met:

The item must be returned within 14 days of delivery.

The item must be unworn, unwashed, and in its original condition with all tags attached.

Items marked as "Final Sale" or "Non-Returnable" cannot be returned or exchanged.

Intimate apparel, swimwear, and accessories (earrings, hair accessories, etc.) are non-returnable for hygiene reasons unless defective.

You must provide proof of purchase (order confirmation or receipt).

7.2 Return Reasons & Resolution

The type of resolution available depends on the reason for return:

7.3 Return Process

To initiate a return or exchange, please contact our customer service team at 【你的企业邮箱】 within 14 days of receiving your order. We will provide you with a Return Authorization (RA) number and instructions on how to return your item to our Guangzhou warehouse. Returns sent without an RA number may not be accepted or may experience significant delays in processing.

You are responsible for the cost of return shipping unless the item is defective or we sent the wrong item. As returns must be sent to our warehouse in Guangzhou, China, international return shipping costs may be significant. We recommend using a trackable shipping service and retaining proof of postage, as we are not responsible for items lost in transit back to us.

7.4 Refunds

Once your return is received and inspected at our Guangzhou warehouse, we will send you an email to notify you that we have received your returned item and whether your refund has been approved. Approved refunds will be processed within 7–14 business days and will be credited to your original method of payment. Please note that shipping fees are non-refundable unless the return is due to our error (e.g., defective or wrong item).

7.5 Exchanges

If you wish to exchange an item for a different size or color, please contact us as soon as possible. Exchanges are subject to product availability. If the desired item is not available, we will offer you a store credit or refund instead.

8. Sizing & Product Descriptions

We make every effort to display our products as accurately as possible. However, we cannot guarantee that your computer monitor's display of any color will be completely accurate.

Product descriptions, sizing guides, and measurements are provided for general guidance only. Sizing may vary between styles and manufacturers. We recommend reviewing the size chart provided on each product page and comparing your measurements before placing an order. If you are between sizes or need assistance, please contact our customer service team.

To the fullest extent permitted by applicable law, we do not warrant that the product descriptions, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free. If a Product offered by us is not as described, your sole remedy is to return it in unused condition for a refund or exchange in accordance with our Return Policy.

All content on our Site, including but not limited to text, graphics, logos, images, product photographs, product descriptions, audio clips, digital downloads, data compilations, and software, is the property of Chanlay International Trading Company or its content suppliers and is protected by Hong Kong and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit this Site or any portion of it unless expressly permitted by us in writing.

The trademarks, logos, and service marks displayed on the Site are registered and unregistered trademarks of Chanlay International Trading Company and others. Nothing contained on the Site should be construed as granting any license or right to use any trademark without our prior written permission.

10. User Conduct

To the fullest extent permitted by applicable law, Chanlay International Trading Company and our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the services or products procured using the Site.

Our total liability to you for all losses, damages, and causes of action arising out of or relating to these Terms or your use of the Site shall not exceed the total amount paid by you to us during the six (6) months immediately preceding the event giving rise to the liability.

The limitations of liability set out above shall apply regardless of whether we have been advised of or should have been aware of the possibility of any such losses arising.

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall first be attempted to be resolved through good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to mediation in accordance with the mediation rules of the Hong Kong International Arbitration Centre (HKIAC).

If mediation is unsuccessful, the parties agree to submit to the non-exclusive jurisdiction of the courts of Hong Kong.

Nothing in this section shall prevent a Malaysian consumer from bringing a claim in the courts of Malaysia or from relying on the protections afforded to them under the Consumer Protection Act 1999 of Malaysia, where such claim relates to their statutory consumer rights.

14. Changes to These Terms

We reserve the right to update, modify, or replace any part of these Terms at any time without prior individual notice. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, such provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
